TRADEMARK REGISTRATION IN MALAYSIA

Trademark protection in Malaysia is governed by the Trademarks Act 2019 and Trademarks Regulations 2019, effective 27 December 2019. These laws are administered by the Intellectual Property Corporation of Malaysia and protect registered trademarks and service marks. Proprietors can assign, license, or deal with their trademarks, while unauthorized registration of well-known marks and importation of counterfeit trademarks are prohibited under TRIPS compliance.

Malaysia is a member of several WIPO-administered treaties, including:

  • The Madrid Protocol

  • The Nice Agreement

  • The Vienna Agreement

  • The Paris Convention for Industrial Property Protection.
